J.B.B. Investment Partners v. Fair, A140232N
In this consolidated appeal, the trial court’s order enforcing the parties’ settlement, in which defendant Fair’s printed name at the end of an email agreeing to settlement terms was found to be an “electronic signature,” is reversed, and the trial court’s order denying plaintiffs attorney fees is affirmed, where: 1) the trial court erred in determining that Fair’s printed name at the end of his e-mail was enforceable under either California’s Uniform Electronic Transactions Act or the law of contract; and 2) since plaintiffs are not the prevailing party, they are not entitled to attorney fees.
