California Court of Appeal

People v. Franco, F067223

Denial of defendant's petition for recall and resentencing (under the Three Strikes Reform Act) of his 25-to-life sentence is affirmed, where, despite the fact that the trial court has the authority to obtain a supplemental probation officer's report at the stage of the proceedings at which it must determine whether resentencing a petitioner would pose an unreasonable risk of danger to public safety, the trial court is not required to do so.
