Order denying defendant’s petition for recall of his sentence and request for resentencing under the Three Strikes Reform Act is affirmed, where: 1) the People met their burden of proving, by a preponderance of the evidence, facts on which a finding that resentencing defendant would pose an unreasonable risk of danger to public safety could be based; and 2) the trial court did not abuse its discretion in deciding not to resentence defendant.
