California Court of Appeal

Judge v. Nijjar Realty, Inc., B248533

In this case, plaintiff appeals from an order vacating an interim arbitration award, but the appeal is dismissed, where: 1) the order from which plaintiff appeals vacated a "clause construction award" that did not resolve the entire arbitration and instead determined only that plaintiff's class and representative claims were subject to arbitration; and 2) because the arbitrator has not ruled on any of the substantive issues in the arbitration, the order from which plaintiff appeals did not vacated a final arbitration award and is not appealable.
