Judgment in favor of plaintiff City on its contract claims and claims for intentional misrepresentation, negligent misrepresentation, and violation of the false claims acts is reversed and remanded with directions to conduct a new trial limited to these claims, where defendant waived the issue of plaintiff using any evidence at trial that was procured with the participation of the City Attorney’s Office (who were vicariously disqualified from representing plaintiff in this lawsuit) because defendant failed to timely raise the issue.
