Safari Associates v. Super. Ct., D065684

Petition for writ of mandate directing the trial court to vacate its order correcting the arbitrator's award of damage, attorney fees, and costs is granted, where: 1) under the circumstances of this case, the arbitrator acted within the scope of his powers in applying the definition of prevailing party found in Civil Code section 1717(b)(1) in awarding plaintiff attorney fees; and 2) any error that the arbitrator may have committed would constitute legal error, which is not subject to correction in the trial court.
