Conway v. County of Tuolumne, F067505

In this case, officers from defendant County fired a tear gas canister into plaintiff's mobile home in an unsuccessful attempt to capture and apprehend plaintiff's son, who had reportedly fired shots at plaintiff. The son was not inside, and plaintiff brought suit for damage caused to his mobile home by the tear gas. Summary judgment in favor of the County is affirmed, where, under the facts and circumstances of this case, and based on the applicable law (Government Code section 820.2), the County is immune from liability for the conduct of its officers.
