In this case, defendants appeal the denial of their anti-SLAPP special motion to strike plaintiff’ first amended complaint, and plaintiff cross-appeals the trial court’s denial of his request for attorney fees in defending the motion. The denial of defendants’ motion to strike is affirmed, and the denial of attorney fees is reversed and remanded, where: 1) plaintiff’s complaint is not directed at protected activity; and 2) the court must determine whether defendants’ motion was frivolous or solely intended to cause delay, and, if so, award costs and reasonable attorney fees to plaintiff as a sanction.
