In this case, defendant California Gambling Control Commission held in trust for plaintiff Tribe certain funds generated from Indian gaming and that the Commission is required to distribute to the Tribe on a quarterly basis. Summary judgment in favor of the Commission is affirmed, where: 1) the Tribe is currently in the middle of an unresolved dispute over its leadership and membership; and 2) the Commission may legally refrain from distributing the funds to the Tribe in light of the current tribal leadership and membership dispute.
