Helgestad v. Vargas, G048888

Denial of Jackson credits to the Father on grounds that this case did not fit the Jackson pattern of a child support order which originated in a divorce proceeding (the Father and Mother were never married), and because there was a period of cohabitation and not total reversal of custody, is reversed and remanded, where: 1) the same equitable considerations that apply to support orders arising out of marital cases should also apply to support orders arising out of paternity cases; and 2) there is no reason to differentiate total changes of custody from periods of living together in the same household.
