California Court of Appeal

Lin v. Coronado, B248848

In this case, plaintiff alleges that a trustee's deed that was executed and recorded omitted her name, which had been included in the original, unrecorded trustee's deed, and that the alteration to the original deed renders it void, giving defendant-transferee no interest in the property at-issue. Dismissal of plaintiff's complaint is affirmed, where alteration of the deed to omit plaintiff's name was not material because the original version of the deed showed that she had no interest in the property.
