Denial of defendant's petition to compel arbitration is reversed, and denial of plaintiff's sanctions motion is affirmed, where: 1) plaintiff and defendant are subject to both individual and collective bargaining agreements; 2) plaintiff is required to arbitrate her statutory claims under the individual arbitration agreement; 3) the individual arbitration agreement is enforceable because it is consistent with the collective bargaining agreement; and 4) the opinion in J.I. Case Co. v. NLRB does not permit the court to refuse to enforce the arbitration clause in the individual agreement which is subject to the Federal arbitration Act.
