California Court of Appeal
Overstock.com, Inc. v. Goldman Sachs Group, A133487
Sealing order denying motions by defendants to seal documents submitted in connection with defense motions for summary judgment is affirmed as to most of the trial court's sealing decisions but reversed as to certain key exceptions, where: 1) plaintiffs submitted thousands of pages of documentation to the court that were never cited and which were irrelevant to the issues raised by the summary judgment motions; 2) irrelevant materials have no bearing on the trial court's adjudicatory function and are thus not within the ambit of the public's right of access to court records; and 3) certain materials that were relevant to the summary judgment proceedings contained confidential financial information of third parties and should have been sealed under the sealed records rule.
