California Court of Appeal

Giorgio v. Synergy Management Group, B248752

In this case, the denial of defendant's motion to set aside entry of default and any subsequent default judgment in favor of plaintiff - alleging that he was never properly served with the original or first amended complaint - is affirmed, where: 1) defendant rendered physical service impossible; 2) the only address on record associated with defendant was his Los Angeles residence, and substantial evidence supported plaintiff's election of newspaper in Los Angeles as the newspaper most likely to give actual notice to defendant; and 3) service by publication was therefore proper.
