California Court of Appeal

People v. Hussain, C074397

Conviction of defendant for grand theft of an automobile is reversed despite there being sufficient evidence to support defendant's conviction, where: 1) the evidence supported a claim of right instruction; and 2) trial counsel was ineffective in failing to request that a claim of right instruction be given and this failure resulted in prejudice to defendant.
