Paulek v. CA Department of Water Resources, E060038

Denial of plaintiff's petition for a writ of mandate under the California Environmental Quality Act (CEQA) directing defendant to vacate its approval of the final environmental impact report (EIR) with respect to a Dam Remediation Project is affirmed, where: 1) plaintiff has standing; 2) plaintiff fails to show any unmitigated environmental impact of the two-part program considered in the final EIR and approved by defendant; and 3) plaintiff has failed to meet his burden of showing defendant's responses to written comments regarding the draft EIR to be inadequate.
