In this action, defendant-tenant objected to an increase in rent after plaintiff-landlord converted a rent-controlled apartment building to condominiums and obtained a new certificate of occupancy based on the change in use. Judgment entered in favor of defendant-tenant is affirmed, where, under section 1954.52(a)(1) of the Civil Code (the Costa-Hawkins Rental Housing Act) the unit is not exempt from rent control, as the exemption for units that have a certificate of occupancy issued after 1995 refers to certificates of occupancy issues prior to residential use of the unit.
