California Court of Appeal

Jones v. Wachovia Bank, H038382

In this action, plaintiffs seek damages under the doctrine of promissory estoppel after losing their home in a foreclosure sale which they understood, based on a phone conversation with defendant bank, would be postponed 10 days after the actual sale date. Summary judgment in favor of defendant is affirmed, where plaintiffs have failed to establish a triable issue of material fact regarding detrimental reliance or injury under the doctrine of promissory estoppel.
