California Court of Appeal

Johnson v. Appellate Division, H039764

In this proceeding, petitioner sought writ relief from a decision affirming a judgment convicting him of a misdemeanor. Only two judges heard his appeal. Petition for rehearing is granted, where the appellate division violated Code of Civil Procedure section 77(b) by hearing petitioner's appeal with only two judges rather than the prescribed three.
