Indio Police Command Unit Association v. City of Indio, G050051

Judgment granting a permanent injunction in favor of plaintiffs, prohibiting defendant City from implementing a planned reorganization of the Police Department's command staff until it demonstrated full compliance with the "meet and confer in good faith" requirements of the Meyers-Milias-Brown Act (MMBA), and post judgment order granting plaintiffs attorney fees, are affirmed, where: 1) substantial evidence supports the conclusion that the City did not meet and confer conceding the reorganization plan in good faith; and 2) the record supports the trial court's implied findings, and thus the court did not abuse its discretion in deciding that plaintiffs were entitled to attorney fees under Code of Civil Procedure section 1021.5.
