Lunada Biomedical v. Nunez, B243205

Orders granting defendants' Code of Civil Procedure section 425.16 anti-SLAPP motions and awards of attorney fees are affirmed, where: 1) the declaratory relief action is subject to the anti-SLAPP statute as it arose out of protected activity provided by that statute, and the motion to strike was properly granted because the declaratory relief action had no probability of success; and 2) after receiving a statutory notice, a potential defendant in a Consumer Legal Remedies Act (CLRA) damages action may not maintain a declaratory relief action to establish that there was no violation of the CLRA.
