Award of attorney fees to plaintiff law firm, ELG, as the prevailing party on a Code of Civil Procedure section 425.16 anti-SLAPP motion is reversed, where the work on the anti-SLAPP motion was performed by an ELG attorney, who, despite being paid in a manner different than a regular employee so as to render him an independent contractor for tax purposes, is not therefore separate counsel for purposes of attorney fees under the anti-SLAPP statute.
