In this case, petitioner-Mother alleges that the juvenile court acted improperly in setting a section 366.26 permanent plan hearing because active efforts were not made to prevent the breakup of the Indian family as required by the Indian Child Welfare Act. Petition for extraordinary relief to set aside the juvenile court's order setting a permanent plan hearing is denied, where: 1) the Mother suffered serious and ongoing substance abuse problems; and 2) evidence supports a finding that active efforts were made to assist the Mother with her substance abuse problem, to assist her in finding housing, and to assist her with finding a job.
