California Court of Appeal

In re Francisco D., B251917

Order removing Mother's adoptive son from her care is affirmed, where: 1) substantial evidence supports the juvenile court's findings that the son came under the court's jurisdiction per section 300(j) of the Welfare and Institutions Code, that substantial danger to the son existed if he remained in the Mother's care, and that there were no reasonable means to protect the son except by removal; and 2) the Indian Child Welfare Act is inapplicable as the son is neither a member of an Indian tribe, nor is he the biological child of a member.
