California Court of Appeal

People v. Doss, A137203

Following defendant's conviction for assault with a deadly weapon and battery, judgment was entered revoking defendant's right to represent himself under Faretta v. California. Judgment is conditionally reversed and remanded for a new hearing to apply the correct legal standard, where: 1) the trial court failed to adequately consider the availability and suitability of alternative sanctions, pursuant to People v. Carson; and 2) the trial court never determined that defendant's behavior constituted "serious and obstructionist misconduct" that "seriously threatened the core integrity of the trial."
