California Court of Appeal
Vasquez v. CA School of Culinary Arts, B250600
Order awarding plaintiffs attorney fees and costs incurred after successfully opposing real party in interest Sallie Mae's motion to quash a business records subpoena is affirmed, where: 1) Sallie Mae lacked substantial legal and factual justification for its refusal to comply with the subpoena, as section 1985.8 of the Code of Civil Procedure authorized plaintiffs to request the electronically stored information at-issue; and 2) plaintiffs offered to pay for the reasonable cost of extracting the electronically stored information from an existing database, but Sallie Mae refused to provide the requested cost estimate.
