In this tort proceeding alleging causes of action for negligence and a dangerous condition of public property, petition for writ of mandate filed by defendant seeking to compel summary judgment is granted, where: 1) Government Code sections 915(c) and 915(e) explain that a government claim must be mailed or personally delivered to the secretariat, and that even if it is not mailed or personally delivered, that it is sufficient for service if the secretariat actually receives it; 2) the secretariat in this case never actually received the government claim; and 3) mailing a government claim to the Victim Compensation and Government Claims Board does not constitute proper presentation of the government claim.
