California Court of Appeal

Davler v. Arch Insurance Company, B252830

In this insurance coverage action tendered by plaintiff-employer against defendant insurance company, in which employees brought various employment claims including sexual harassment, invasion of privacy, and false imprisonment, the trial court's dismissal without leave to amend is affirmed, where: 1) the employment-related practices exclusion is unambiguous; 2) the employment-related practices exclusion is sufficiently plain and clear and an average layperson would understand that the exclusion applies a category of claims; and 3) plaintiff does not state that or how it could amend its complaint to allege facts that the underlying claims were not employment-related.
