Castaneda v. Ensign Group, B249119

In this class action seeking damages for nonpayment of minimum and overtime wages, defendant Ensign corporation has no employees but owns a corporation with employees, the same corporation with which plaintiff was employed. Summary judgment in favor of defendant is reversed, where: 1) if defendant exercises some control over the corporation with employees, it may also be the employer of the employees of the corporation it owns; and 2) there are triable issues of fact as to whether defendant was plaintiff's employer.
