Order committing defendant sexually violent predator to the California Department of Mental Health for an indeterminate term under the Sexually Violent Predator Act (SVPA) is reversed and remanded for reconsideration of defendant's petition for conditional release, where the trial court did not apply the correct standard in making the threshold determination of whether defendant’s petition for conditional release was based on frivolous grounds within the meaning of section 6608(a) of the SVPA.
