California Court of Appeal

People v. Johnson, F066627

Defendant, a ward of the juvenile court, was charged with numerous criminal counts including felony possession of a firearm and active participation in a criminal street gang. Conviction and sentence of defendant is reversed as to the convictions for gang participation on counts 3 and 6, where, in view of People v. Rodriguez, substantial evidence did not establish that defendant promoted, furthered, or assisted in the perpetration of felonious conduct by at least two gang members.
