California Court of Appeal

People v. Christman, A138287

In this action challenging a placement order allowing a conditionally-released sexually violent predator (SVP) to be placed in proximity of an elementary school, the trial court's order is reversed, where: 1) in determining compliance with the Welfare & Institutions Code section 6608.5 subdivision (f), the distance between defendant-SVP's residence and the elementary school should have been calculated using the straight-line method rather than the pedestrian-route method; and 2) using the straight-line method, defendant's residence is less than one-quarter mile from the elementary school.
