People v. Canizales, E054056A

Conviction of defendant Canizales for first degree murder is reversed, where: 1) following the original decision by this court, the California Supreme Court held in People v. Chiu that "a defendant cannot be convicted of first degree premeditated murder under the natural and probable consequences doctrine"; and 2) because it cannot be determined beyond a reasonable doubt that the jury based its verdict of first degree murder on the legally valid theory that Canizales aided and abetted premeditated and deliberatee murder, the conviction must be reversed and the People given the opportunity to retry him.
