California Court of Appeal

Bounds v. Super. Ct., B254505

Order sustaining demurrer to plaintiffs' financial elder abuse claims is vacated, where because property rights include the right to use and sell property, plaintiffs' allegations that plaintiff-elder entered into an executory agreement which significantly impaired the value of the property adequately pleads a "taking" or "deprivation of a property right" within the meaning of the Elder Abuse and Dependent Adult Civil Protection Act, section 15610.30(c) of the Welfare and Institutions Code.
