Order vacating an arbitration award issued in favor of defendant-employer in a wrongful termination suit is reversed, where: 1) the neutral arbitrator failed to comply with the mandatory disclosure requirements of the Code of Civil Procedure section 1281.9; 2) under the forfeiture principles stated in Dornbirer v. Kaiser, the court could find that plaintiff's counsel forfeited the right to seek to have the award vacated on the basis of such failure to comply; and 3) the forfeiture principles stated in Dornbirer remain viable after the enactment of section 1281.85(c).
