In this action against defendants for statutory violations arising out of defendants' alleged business practice of inflating their credit ratings, defendants' appeal of the denial of their special motion to strike plaintiff's California False Claims Act (CFCA) causes of action pursuant to the anti-SLAPP statute (section 425.16(b) of the Code of Civil Procedure) is dismissed, where the superior court's order denying the special motion to strike is not appealable as subjecting public prosecutors to the direct appeal process authorized by section 425.16(i) would undermine legislative intent by impeding the prosecutor's efforts to protect the health and safety of the citizenry and delaying the enforcement action.
