San Diego Gas and Electric Company v. Schmidt, D062671
In this eminent domain proceeding in which the parties could not agree on an appropriate valuation for defendants' property, and in which the jury valued the property at $8 million, judgment denying plaintiff's motion for judgment notwithstanding the verdict is affirmed, where: 1) the evidence was legally sufficient to support the jury's verdict; 2) the trial court did not abuse its discretion in limiting cross-examination of defendants' appraisal expert and allowing the appraiser to testify; and 3) as the trial court erred in denying defendants’ motion for litigation expenses, that order is reversed.
