Conviction of defendant juvenile for felony carrying of a concealed firearm is reversed and remanded for appropriate proceedings to determine whether defendant is suitable for deferred entry of judgment and, if not, whether the offense is a felony or misdemeanor, where: 1) the trial court erred following defendant’s guilty plea to carrying a concealed firearm on his person by determining the offense punishable as a felony under Penal Code section 25400(c); and 2) the prosecutor erroneously determined that defendant was ineligible for deferred entry of judgment.
