California Court of Appeal

Bloxham v. Saldinger, H038040

In a dispute over the location of the parties' common property lines, judgment quieting title in favor of plaintiffs is affirmed, where: 1) there is no basis for concluding that plaintiffs' 2009 survey was insufficient as a matter of law; and 2) the trial court did not abuse its discretion by denying plaintiffs' motion to recover their cost of proving the location of the common boundary lines of the parties' properties based on defendant Barbara Saldinger's failure to admit a request for admission.
