Dismissal of an action brought by plaintiff, an out of network medical provider, who provided non-emergency medical services to a participant of a health plan covered by defendant, seeking recovery of its customary and usual rate, is affirmed, where: 1) defendant paid a small portion of the amount charged for the services; and 2) the trial court properly concluded that there is no contractual or other requirement that defendant pay plaintiff its usual and customary rate.
