California Court of Appeal
In re J.G., A139869
The juvenile court's order finding that defendant-minor committed felony possession of a concealed firearm is reversed and remanded, where: 1) under the circumstances here, the officer's request that defendant sit on the curb resulted in a detention; 2) as a result, the ensuing search of the backpack violated the Fourth Amendment; and 3) the juvenile court's denial of defendant's motion to suppress the firearm was therefore improper.
