Plaintiffs have failed to state a cause of action under The Confidentiality of Medical Information Act, where: 1) a thief stole a health care provider's computer containing medical records of about four million patients; 2) plaintiffs do not allege that the stolen medical information was actually viewed by an unauthorized person; and 3) the mere possession of the medical information or records by an unauthorized person is insufficient to establish breach of confidentiality if the unauthorized person has not viewed the information or records.
