People v. Speight, G049626

Defendant's convictions and sentence for two counts of premeditated, willful, and deliberate attempted murder and various enhancements are: 1) affirmed in part as to the convictions, where the trial court erred in instructing the jury on the interaction between attempted murder and attempted voluntary manslaughter, but defendant was not prejudiced; but 2) reversed in part as to defendant's sentence and remanded for resentencing, where defense counsel's performance was deficient regarding sentencing, and defendant was prejudiced by this error.
