Nevarez v. Tonna, H039209
The trial court's issuance of a two-year restraining order under the Domestic Violence Prevention Act (DVPA) against defendant is affirmed, where: 1) the trial court was not required to find a probability that defendant would commit future abuse before issuing a restraining order under Family Code section 6300; 2) there is evidence to support the trial court’s finding that defendant committed "abuse" within the meaning of section 6203; and 3) plaintiff's testimony was not "inherently improbable or incredible" such that this court should reject the trial court's determination regarding her credibility.
