California Court of Appeal
Dept. of Fair Employment and Housing v. Ottovich, A136607
In an action alleging defendant engaged in housing discrimination, the trial court's finding that defendant engaged in abusive discovery tactics, order striking his answer to the complaint, and judgment in favor of plaintiff, are affirmed, where: 1) the trial court's order vacating the default judgment against defendant left intact its prior order striking defendant's answer; 2) the trial court was not required to reinstate his answer when it vacated the default judgment; and 3) the trial court did not abuse its discretion in failing to grant relief under Code of Civil Procedure section 473.
