California Court of Appeal

People v. Iraheta, B249264

The trial court's grant of defendant's motion for a new trial, following the jury finding him guilty of shooting at an occupied motor vehicle is reversed and remanded, where 1) the trial court properly declined to instruct on imperfect self-defense on the charge of shooting at an occupied motor vehicle; and therefore, 2) its ruling granting a new trial was an abuse of discretion.
