California Court of Appeal

People v. Elder, C067983

Defendant's convictions of two counts of kidnapping for robbery, two counts of robbery, and one count of assault with a deadly weapon, each count involving personal infliction of great bodily injury (GBI), are affirmed, where: 1) defendant’s contentions regarding the GBI enhancements fail; and 2) defendant was a direct cause of the injury sustained by the victim, because that injury was inflicted as the victim resisted the commission of the charged crimes and during his attempt to restrain defendant.
