California Court of Appeal

People v. Diaz, D063686

Defendant's convictions for gross vehicular manslaughter while intoxicated, driving under the influence causing injury, driving with a measurable blood alcohol causing injury, and driving with a suspended license for an alcohol-related offense with a prior conviction, after his first trial, and his conviction for murder after a retrial on that charge only, are: 1) reversed in part with regard to the murder conviction, where the trial court erred in permitting the jury in the retrial on the murder charge to view two videos concerning the consequences of alcohol-related driving offenses, and the error was prejudicial; but 2) affirmed in part, as to all of the remaining counts.
