Dismissal of plaintiff's complaint concerning a failed home loan modification and eventual foreclosure is: 1) affirmed in part, with regard to the causes of action for general negligence, breach of fiduciary duty, and an accounting; but 2) reversed in part, as to the causes of action for breach of contract, negligent misrepresentation and unfair business practices, where the trial court should have granted plaintiff leave to amend.
