American Indian Model Schools v. Oakland Unified School District, A139652
In a challenge to defendant-school district's decision to revoke plaintiff's three charters after an independent audit uncovered evidence of conflict of interest violations, fiscal mismanagement, and improper use of public funds at the three charter schools, the trial court's issuance of a preliminary injunction to maintain the status quo pending resolution of the appeal of the revocation decision is affirmed, where: 1) the trial court correctly interpreted Education Code section 47607(c)(2), as requiring a decision to revoke to be supported by substantial evidence that defendant-district complied with this provision; 2) the trial court correctly concluded that the Revocation and Report are devoid of any evidence indicating that defendant-district considered test scores for pupil subgroups; 3) the trial court properly found that it had the authority to issue an injunction that continued the funding to plaintiff's charter schools while plaintiff pursued its administrative and court challenges to defendant-district's revocation decision; and 4) the trial court had jurisdiction to issue a preliminary injunction.
